Article 1 - Purpose

These General Conditions of Sale are intended to define the rules applicable within the framework of the sale of Products marketed on the Site (hereinafter “the Site”),

These conditions apply to all orders placed on the Site.

These general conditions (hereinafter the “General Conditions of Sale”) govern without restriction the sales of Products made by Le Petit Florilège from the Site.

Le Petit Florilège reserves the right to modify these General Conditions of Sale at any time without notifying its Customers, by publishing a new version on the Site.

The General Conditions of Sale described below detail the rights and obligations of Le Petit Florilège and the Customer in the context of the sale of goods on the Site.

The applicable General Conditions of Sale are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Conditions of Sale.

These General Conditions of Sale comply with articles l 111.1 and l 113.3 of the Consumer Code informing the Customer of prices, descriptions, contractual liability limitations and details of the sale.

Article 3 - Presentation of Products

The characteristics of the Products offered for sale are presented in the Product sheets of the Site by means of photograph(s), image(s), descriptive text, conditions of use, any special characteristics and prices including tax. Le Petit Florilège cannot be held liable if errors have been introduced. Due to the diversity of materials likely to be used by the Customer for displaying the Site and the possible variations in colorimetric and qualitative reproduction of the photographs of Products on said materials, the photographs do not enter into the contractual scope.

The Products are presented in a staged context allowing them to be highlighted and the photographs represent a presentation suggestion. Only the description on the product sheet and the selection menu (if it exists) have the value of description and designation of the product or its variant validated by the customer. All texts, images, videos and audio extracts presented on the Site are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.

Article 4 - Duration of validity of sales offers

The Products are offered for sale until stocks are exhausted. In the event of an order for a Product that has become unavailable, the Customer will be informed of this unavailability as soon as possible by email or by post.

Article 5 - Prices

Each Product sheet on our site indicates the price of each Product in euros, freely set by Le Petit Florilège, expressed including all taxes, excluding shipping costs. The amount of VAT is specified when the Customer consults the shopping cart and the shipping costs (covering packaging and delivery costs) relating to it are also indicated on the cart.

Le Petit Florilège reserves the right to modify its prices at any time but the Products ordered are invoiced at the price in effect when the order is registered.

All prices are non-negotiable by the Customer.

No discount will be granted to the Customer in the event of early payment.

Article 6 - Basket

The Shopping Cart page summarizes all the Products selected by the Customer and indicates to the Customer the shipping costs (including packaging and delivery costs) inherent to his order. The page provides the Customer with a "Recalculate" button that allows him to update the subtotals, totals and shipping costs, in the event of a change in quantities or in the event of a Product deletion.

Purposes of processing

The collection of personal information is essential for billing, processing and routing orders.

After validating the Shopping Cart, the Customer must identify himself if he already has a personal account on the Site or create one. The creation of a personal account on the Site implies the unreserved acceptance of these General Terms and Conditions of Sale by checking the box "I accept the conditions of use", which are presented to the Customer on the account creation page.

After validating the shopping cart, the Customer indicates their billing and delivery details, also indicating whether these details are different or identical.


Article 8 - Order


The Customer validates his order when he activates the "Pay order" link at the bottom of the "Summary" page. Before this validation, the Customer is systematically asked to check each of the elements of his order; he can thus correct any errors and has the option at any time to identify and correct any errors made when entering his data.

He must check in this order form all the information transmitted, and in particular all the elements useful for the delivery (delivery address, digital code, telephones, etc.) of his order. The address supplement must not exceed 32 characters at the risk of being truncated. Le Petit Florilège cannot be held responsible in the event that the delivery cannot be made due to exceeding the maximum number of characters in the address supplement.

Orders cannot be cancelled or modified once validated and paid.


The order placed by the Customer is only effective upon conclusion of full payment of the amounts due.

If due to force majeure (strike, natural disaster, cessation of activity, death, illness, accident, war, etc.) Le Petit Florilège is unable to honor an order for Products made to measure or according to the Customer's specific specifications, a full refund of the sums previously paid for this order will be made and the Customer will not be able to take any legal action to repair any damages caused.

Article 9 - Payment terms

Payment for orders is made by credit card only.

In the case of an order from an area other than the area defined by these General Conditions of Sale, a payment method by bank transfer may be offered to the Customer by Le Petit Florilège.

When registering the order, the Customer must pay for the entire order using the payment methods offered by the Site at the time of the order.

The Site offers the customer an online payment with its banking partner Crédit Agricole via the secure e-Transactions payment system and via the Paybox system.

This system is compatible with 3D Secure, Verified by Visa or SecureCode Mastercard certified bank cards.

If the Customer makes the payment with a 3D Secure or Verified by Visa or SecureCode Mastercard registered bank card, he will be asked to identify himself with a personal code guaranteeing his identity to finalize the online payment.

If authentication fails, your order will not be taken into account.

In order to prevent any bank card fraud, Le Petit Florilège reserves the right to refuse any sale for which the payment does not offer all 3D Secure security validations or presents suspicions of fraud.

After payment on the secure server offered on the Site, an acknowledgement of receipt is displayed. It confirms the registration of the order and informs the Customer that an electronic confirmation message including all the elements of the order will be sent to him as soon as possible.

The data recorded by Le Petit Florilège constitutes proof of the nature, content and date of the order. It is archived by Le Petit Florilège under the legal conditions and deadlines; the Customer can access this archiving by contacting the Customer Relations department.

Article 10 - Late payment

In the event of total non-payment of the goods delivered on the day of receipt, the Customer must pay Le Petit Florilège a late payment penalty equal to one and a half times the legal interest rate.

The legal interest rate used is that in force on the day of delivery of the goods.

This penalty is calculated on the amount excluding tax of the sum remaining due, and runs from the due date of the price without any prior formal notice being necessary.

In accordance with articles 441-6 c. com. and D. 441-5 c. com., any late payment automatically entails, in addition to late payment penalties, an obligation for the debtor to pay a fixed compensation of €40 for recovery costs.

Additional compensation may be claimed, with supporting documents, when the recovery costs incurred are greater than the amount of the fixed compensation.

Article 11 - Delivery

Delivery of Products will be carried out only by the services of La Poste or DPD in mainland France.

For delivery to another area listed on the Delivery page, routing and delivery will be carried out by a La Poste partner in the country concerned and the delivery time may be extended. For delivery to an area not listed on the Delivery page, a written request by email must be made using the contact form made available to the Customer. Le Petit Florilège reserves the right to accept or refuse delivery to another area.

Delivery methods vary depending on the type and weight of the package, or at the seller's discretion:

- Colissimo without signature for light packages

- Colissimo against signature for packages over 3kg whose value requires additional insurance at the seller's discretion.

- DPD Predict against signature or personal code for bulky packages


- Colissimo collection point (Post Office or at my local retailer).

In the event that the customer chooses delivery to a Colissimo collection point, the customer is informed that the chosen collection point may refuse to accept the package (in particular in the event of saturation of its capacity to accept the package, change of opening hours, exceptional closure, etc.) in which case the package will be directed to a new collection point or a post office located on the carrier's route. Le Petit Florilège cannot be held responsible for this change of delivery location and the customer cannot request compensation for any inconvenience caused by a change of collection point compared to that defined when placing the order.

It is the customer's responsibility to refuse any package showing signs of damage or whose packaging has suffered damage during transport, as soon as it is delivered by La Poste. If the customer accepts a damaged package, this is equivalent to accepting the goods as is and Le Petit Florilège cannot be held responsible for any damage caused to the goods by our delivery operator.

A parcel tracking number will be sent by email to the Customer for Colissimo items as soon as their order is shipped.

Delivery times are generally set, for an address in metropolitan France, on the day of payment validation + 8. This period may be extended in the event of public holidays during this period or if the store is closed during the holiday period (an announcement visible on the home page will inform the customer of the new order processing methods and the extension of delivery times).

Delivery times for Products made to order or according to the Customer's specific specifications are set at a maximum duration of 30 days.

In the case of an order combining new products and custom or made-to-order products, shipping may be carried out in several packages and the delivery times specific to each type of product.

Le Petit Florilège will be able to inform the customer directly by email as soon as details of the delivery time are available.

In the event that the Customer provides incomplete or inaccurate delivery information, Le Petit Florilège cannot be held responsible for any delay or impossibility of delivery. In the event that the goods are returned for these reasons, the reshipping costs will remain the responsibility of the customer.

In the case of delivery by Colissimo against signature, if the Customer is not present when the delivery person passes, a delivery notice will be given to him in his mailbox or sent by text message or email, and he will have a period of time available on the carrier's website to collect it from his post office or from a commercial partner of the carrier. At the end of this period, the package will be returned to Le Petit Florilège and the Customer will have to bear the cost of a new shipment.

The Customer is informed that it is his responsibility to check, in the presence of the delivery person, the condition of the package upon receipt and to immediately issue reservations in the event of damage, anomaly or late delivery to the delivery person by mentioning it on the delivery note. In the absence of reservations, the Customer will not be able to take action against Petit Florilège.

If there is any transport damage, we urge you to contact us within 3 days ( article L.133-3 of the French Commercial Code ) and to provide us with photographs of the damaged package, the damaged product and the transport label on the box. After this period, no claims will be admissible and the products will be considered as delivered in good condition.

Article 12 - Right of Withdrawal

In accordance with current legislation, the Customer has a period of 14 (fourteen) working days from the date of receipt of their goods to withdraw and a period of 14 (fourteen) days from their withdrawal to return their package, without justification or penalty.

The right of withdrawal does not apply to personalized products, made to measure or on demand, unsealed products (in particular hygiene products) and fragile products.

The right of withdrawal between professionals can apply when the following three conditions are met only:
- the contract is concluded outside the establishment
- the subject of the contract does not fall within the company's main activity
- the client company does not employ more than five employees

Otherwise the right of withdrawal does not apply.


For any return under this right of withdrawal, the following procedure must be fully respected:

- The Customer will contact Le Petit Florilège via the contact form made available to them where they will indicate their wish to return their product, indicating the order number that will have been communicated to them on their order acknowledgment. In order to improve the offer, the Customer will have the possibility to indicate the reason for return.

- Le Petit Florilège, after validation of the return, will provide the Customer with the return procedure.

- The returned product must be packaged in suitable packaging, guaranteeing the integrity of the product during return transport. The Products must be returned unused, in their original packaging, with their labels and any accessories, in impeccable condition to: Le Petit Florilège - 374 Route de Padirac - 46500 ALVIGNAC-LES-EAUX

- Returns to relay points are not accepted. Packages must be sent directly to the return address provided.

- Unless otherwise indicated, return costs are the sole responsibility of the Customer.

- Cash on delivery returns are not accepted.

Subject to the conditions recalled above, Le Petit Florilège will reimburse the amount including all taxes of the order corresponding to the returned products, excluding initial delivery costs if the return is partial. The Customer's bank account will be credited with said amount, within 14 (fourteen) days from receipt of the Products by Le Petit Florilège.

In the event of damage, loss or destruction of the package during a return, the entire order and return costs will remain the responsibility of the Customer.

Article 13 - Legal guarantee of conformity

Le Petit Florilège undertakes to deliver Products that meet the requirements in force relating to the safety and health of people in accordance with French provisions, and in particular the legislation on regulated chemical substances.

The Site offers products from artisanal manufacturing (textile items, ceramics, etc.), which may result in the presence of variations in color, the presence of variations in shapes, finishes and discolorations which cannot be considered as defects.

The Site also offers used, second-hand, so-called "vintage" Products, which may not comply with the standards in force at the time of purchase; the Customer declares to be informed and to accept them as is.


Article 14 - Customer Relations - After-sales service

For any information, question or complaint, the Customer may contact the Customer Relations department of Le Petit Florilège from Monday to Friday, from 10 a.m. to 5 p.m. by email at serviceclient (@) lepetitflorilege.com or via the contact form on the Site or by post to Le Petit Florilège - Lieu-dit Lamaresque - 46500 PADIRAC

Article 15 - Satisfied or refunded

In accordance with legal provisions, the Customer has 14 clear days from delivery to return his order, the return costs being his responsibility. He will then be reimbursed for the full amount incurred in the event of the total return of his order within 30 days following receipt of it in good condition by Le Petit Florilège. In the event of a partial return, only the amount of the returned product will be reimbursed. On the proposal of Le Petit Florilège, the Customer may also opt for another method of reimbursement.

Products returned as used, incomplete, damaged or soiled will not be accepted and will not be refunded, with the initial and return shipping costs remaining the responsibility of the Customer.

It is also the customer's responsibility to keep the original packaging of the products in good condition for use in order to return their products. Failing this, Le Petit Florilège reserves the right to partially refund returned products that are not in satisfactory condition when put back on sale.

These return terms do not apply to custom-made or personalized products and cannot be refunded.

In accordance with legal provisions, the right of withdrawal cannot be exercised for Products made to order, used "vintage" or second-hand products or according to the Customer's specific specifications.

Article 16 - Sponsorship

The sponsorship program offered by SARL Le Petit Florilège is intended to allow our existing customers (sponsors) to recommend our company to third parties (referrals) who have never placed an order with us. Each sponsor and referral who complies with the conditions of this program will be able to benefit from the advantages specified in the current sponsorship offer.

Any attempt to abuse the program, including but not limited to self-referral, use of multiple accounts belonging to the same person or members of the same household, or any other form of fraud, is strictly prohibited. Referrals must be separate individuals and reside at a different address than the referrer.

We reserve the right to refuse or cancel any reward resulting from improper use, as well as to suspend or terminate affected accounts.

This program is a tool intended exclusively for the acquisition of new customers. Any participation implies acceptance of these conditions as well as the rules of good use defined by SARL Le Petit Florilège. We reserve the right to modify or suspend the program at any time, without notice.

Article 17 – Disputes

The Site and all sites of Le Petit Florilège, whose main domain name is lepetitflorilege.com (blog.lepetitflorilege.com, , …) are governed by French law.

In the event of a dispute, the Customer undertakes to find an amicable solution before any action before the courts. In the event of failure of any amicable solution, any action may be brought only before the French courts.
